Prosecutors are so determined to dismiss Branislav Micunovic’s testifying in front of the court

Brano Micunovic(Podgorica, 05. August 2013) – MANS requested from the Basic Court in Podgorica that from the case evidence that “Lutrija” has against MANS to exempt Branislav Micunovic‘s medical records, made by medical institution CODRA from Podgorica, because of the objective suspicion in that medical record.

In the brief that we submitted to the Basic Court it points on the fact that Lottery has its own media-Television 777 and through that media has business relationship with the private medical institution “Codra” from Podgorica. Among other things, “Lutrija” through this media broadcasts program “Trijaza” every Tuesday in 6:15 pm, with return showing on Saturday in 12:15 pm. Even more, the contact that the Lutrija announces it proves multiple connections with the medical institution “Codra”, since the same contains both names Lutrija and this medical institution: codra@lutrija.co.me.

Consequently, MANS pointed by motion made to the court on the business relationship between the Lutrija and medical institution who made the most of the medical record with a purpose to determine whether the witness Branislav Micunovic is able to present to the court the facts known to him, but at the same time to secure his health and his peace.

The connection between the Lutrija with the institution whose documentation should serve as a basic for the evaluation, it points on a real and objective suspicion in that evaluation, especially since prosecutors are so determined to dismiss Branislav Micunovic’s testifying in front of the court.

We remind that the court previously singled out from the file findings and opinions by psychiatrist Borislav Mitric with agreement to the proposal of a counsel of all parties and a reason for that was a suspicion by the second defendant in impartiality and objectivity of those findings, based on the business connection between the prosecutors with psychiatrist’s brother Borislav Mitric.

In the brief submitted to the court we emphasized the business link of doctor’s brother who made the report and opinion as a reasonable basis for the extraction from the files, so even more directly the business connection between the first defendant with “Codra” is a reason that from the files separate and documentation made in that medical institution. We hope that the court will prove consistency in its own decisions.

Therefore MANS suggested to the court to extract from the files medical documentation made on behalf of Branislav Micunovic issued by medical institution “Codra”, and to worn judicial medical board of the Faculty of Medicine that in the evaluation in his case the witnesses can not be those who are connected with this institution, nor the evaluation can be based on the documentation issued by this institution or other doctors clamming documentation issued by this institution.
