The Government promotes a robbery “in the interest of the citizens”

MarkovicStatement by Deputy Prime Minister Dusko Markovic that tax on fuel will import again based on the Law once again shows that the executive branch is persistent in violation of the Constitution and takeover competences of the Parliament, and that is determined to carry out the policy that is contrary to the public interest and the interest of the citizens of Montenegro. This especially related to the reason that for the introduction of new material obligations to citizens is needed qualified majority in the Parliament. Thus, the highest representatives of the executive branch publicly show that they are determined to continue with the same practice in the future, rather than to bear the responsibility for the adoption of the Decree by which the citizens of Montenegro in recent months are looted for several million euros.

We recall that MANS immediately after the submission of an initiative to the Constitutional Court pointed out that it is the simplest legal issue that judges of the Constitutional Court can resolve an a few minutes and that is why we in the initiative proposed that the Constitutional Court suspend the implementation of all decisions made on the basis of this Decree. However, the Constitutional Court clearly did not act in the interest of protecting the constitutionality and legality, and in order to prevent the occurrence of irreparable damages. Instead, the Constitutional Court complied with the recommendation of the Government and stopped the procedure as much as half a year, thus allowing citizens to suffer damage amounting to almost 10 million because the Government violated the Constitution.

Even more, that the the executive branch can violate the Constitution with impunity and take over the responsibilities of other institutions, or fully controlled other institutions in the implementation of decisions that cover the cost of bad policy and high corruption, is evidenced by the fact that the Constitutional Court is now further delaying the submission of their decision to the Official Gazette for the publication and to entry into force. Thus, by failing to perform official duties in the Constitutional Court is provided that the Government applying an unconstitutional Decree each day takes away from citizens about 50 thousand of euros.

Failure to perform official duties and exceeding the constitutional and legal authority that has resulted in multi-million damage constitute essential elements of the gravest forms of the criminal offense of abuse of official power. Therefore, it is particularly humiliating allegation of Mr Markovic that “money is not stolen, and that it went into the budget” and that is in the interest of citizens. A similar logic have and the drug lords associated with the executive branch, because and from they we can often hear that they worked in the interest of citizens, that they opened the companies, employed people and payed taxes and contributions to the state budget, as well as that in 90s of last century state business and cigarette smuggling business was “in the public interest”.

Violation of the Constitution and the Law, especially by those in charge to execute them, can not be in the interests of citizens, as illustrated by Dusko Markovic. Such behavior can only be in the interest of those engaged in corruption and tycoons whose interests this Government represents and protects.

So once again we invite all relevant institutions to stop further looting of Montenegrin citizens and to respond appropriately to a gross violation of the Constitution and the Law. Also, we believe that no member of the Parliament of Montenegro that is committed to the interests of citizens and respect for the Constitution and the Law, after a months-long looting of citizens will not support the Law, which was announced by Deputy Prime Minister Dusko Markovic. We want to believe that tycoons and actors of corruption who have repeatedly demonstrated that they have the majority for the decision-making in the executive branch, do not have a qualified majority in the Parliament of Montenegro.
