New criminal charges because of Solana – Cadastre Administration should have known about the illegal mortgage

MANS today filed a criminal complaint to the Special State Prosecutor for Organized Crime and Corruption against several persons on suspicion that they illegally burdened state property of Ulcinj Solana in favor of obtaining a loan to a third party.

The criminal complaint was filed against Mico Orlandic, former Director of the Real Estate and Dzevdeta Caprici, the current head of the Ulcinj cadastre, Jelica Petricevic, former Deputy Director General of the First Bank of Montenegro, Dragan Djuranovic, officer of Montenegrin Commercial Bank (CKB), and founder of the company and Flash i Absolute, Veselin Barovic, Bojsa Sotra, Zijad Blekic, Becir Perazic and Vlatko Aprcovic.

According to data obtained by the Research center of MANS, in the period from 2005 to mid-2008, the mentioned individuals made or mediated in the establishment of more adverse credit contracts through which state property is illegally pledged as a mean of ensurance.

In the mentioned period was taken seven loans in total amount of around 5.2 million euros, and as a mean to ensure a mortgage is put state property over which the company “Bajo Sekulic” had only the right to use, not ownership.

From CKB in the period from 2005 – 2006 were taken three loans totaling just over half a million euros, while in 2007 and 2008 were taken four loans from the First Bank of total value of 4.7 million euros.

The first two loans ahead of the company “Bajo Sekulic” signed director at that time Jelena Aleksic, while contracts on placing state property under the mortgage signed now-deceased bankruptcy trustee Milorad Ikovic. The signer of illegal contract on mortgage from CKB was its employee Dragan Djuranovic.

The agreements on loan and a mortgage made in that way were verified without a problem by the Cadastre of Ulcinj, where the decision on putting the burden on state property signed former and present chief of the local Cadastre Dzevdet Caprici. Caprici is at the position as Chief of the Cadastre since 2002 when he became a member of the Municipal Board and the Executive Committee of the ruling Democratic Party of Socialists (DPS) for Ulcinj.

For all other loans that have been taken, the procedure was the same. Mortgage contracts were signed by the bankruptcy trustee, and Chief Caprici a complete job verified by issuing Cadastre solutions which affirmed that the state property is mortgaged. Even when in the decisions was stated that it is only the right to use, not ownership, Ulcinj Cadastre legalized illegal mortgages. In the period of three years, Carpici signed five decisions in total burdening state property with a total of 5.2 million in loans.

Bearing in mind that this is the state land of 15 million square meters in one of the most attractive locations on the coast, there remains very little room for doubt that then Director of the Real Estate, Mico Orlandic had no information about what is happening in the regional unit of the Cadastre in Ulcinj . However, even after taking the seventh loan under the account of the state-owned land, Orlandic did nothing to prevent apparent violations of the law and endangering state property.

It is interesting that the largest loan in the amount of three million euros guaranteed with the state property has not even paid to the company “Bajo Sekulic”, but went directly to the account of Podgorica based company “Flash” which in Solana possessed only a part of the shares. This loan gave first made by the First Bank, represented in this transaction by then Deputy Managing Director Jelica Petricevic, and in behalf of the “Flash” the contract signed one of its founders, Becir Perazic. The company “Flash” was established by Bar based company “Absolute”, together with the Prime Minister’s friend Veselin Barovic, Bios Sotra and Zijad Radmanovic. In addition to Perazic, Bar based  Absolute founded and Vlatko Aprcovic and Cayman offshore company “Balkan Investment Management Limited ” with for now unknown ownership structure. According to data from the Central Registry of business entities, and “Flash” and “Absolute” have been deleted, which makes the fate of the land Solana burdened with mortgages even more uncertain.

MANS invites the Special State Prosecutor’s Office to open a case of Solana, without delay, and before the onset of bigger damages to the state property, prosecute all individuals, especially those from the state administration, who participated in any illegal activities.
